The article deals with the problem of the degree of persuasion necessary for the judge to render a decision, studying the theories developed to authorize a sentence based on probabilities. The author confronts the “principle of preponderance”, created by Swedish scholars, with the solutions adopted in Germany, challenging their outcomes regarding the rights of the parties.
