Abstract

The per curiam and seriatim models of the constitutional courts are studied using as examples the decision making processes for the issuance of collegial decisions in the Venezuelan Sala Constitucional and the Brazilian Supremo Tribunal Federal, each designed to conform to the model of precedents that have been incorporated into the legal systems in which they operate. It is argued that there may be unique models with a tendency to adapt their decision-making processes for the formation and application of precedents.
