Abstract

The Brazilian Civil Procedural Code of 2015 advanced on recognizing the capacity of organisations without legal personality and irregular associations being parties to legal procedures (art. 75, IX of CPC), revealing that, even without personality, these entities have legal capacity. On this basis, the article aim to identify groups that fit in the applicable law, proposing that, upon verification of attributes shared by these entities, the possibility of their act in lawsuits be widely recognized, especially in order to defend their own interests.
