The present work aims, from the perspective of human rights, highlightes relevant social inclusion that can be achieved with the use of efficient means of access to justice. To overcome problems relating to communication is key to the construction joint responses by the parts, being the mediation an efficient mechanism to facilitate dialogue between the parts in the conflict. The role of the mediator favors simplified conversation using the active listening and contributes to face problems related to traditional legal languages. The use of a language accessible to all is characteristic of mediation and collaboration techniques to overcome misunderstandings , enabling the active participation of all in dispute resolution.
