Resumo

The arithmetic equality between the parties in the legal procedure has shown to be insufficient regarding to the legal right of due process for those individuals in situation of vulnerability. The equality thought in this terms appears to be impotent, showing that we ought to use it in a different manner. This papers intends to address this subject.
